Military Defense Lawyer For Discharge Upgrades

When military personnel are discharged, it can occur that they receive an involuntary or less than honorable discharge. This affects their record in a negative way and could affect job opportunities as well as create other harmful effects on their future.  There is a Discharge Review Board (DRB) for every branch of the military where a prior servicemember can apply for a review of the discharge and request that it be upgraded.  The DRB will conduct a hearing to review the data and occasionally personally interview the requesting party.  The DRB will review the basis for the discharge when it originally occurred. This includes reviewing evidence and statements, the length of time since the discharge, current community service and employment, as well as overall achievements and references.  The DRB considers these areas in order to properly determine whether the applicant's character has taken a positive turn, allowing them to see that there has been an improvement in what may have been negative behavior while in the military. A successful petitioner must persuade the DRB that the discharge was either "inequitable" of "improper". Personal appearance before the Review Board is also possible.

Even if a petition was denied in the past, a reconsideration can be requested in some cases, such as the discovering of new evidence.
